Terms of Service

The short version

Mountain Creative Directory (the “Service”) is a review + delivery platform for filmmakers. You upload videos and files, share links with collaborators or clients, and they review or download. You own your content. We host it. These Terms describe what each of us is responsible for.

The Service is operated by Nicholas Kalisz, doing business as Mountain Creative Directory, in Colorado, USA. Questions or concerns: nicholaskalisz@gmail.com.

1. Your content stays yours

You retain all rights to any video, image, audio, project metadata, or other content you upload (“Your Content”). We don’t claim ownership of it.

To run the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, copy, transcode (via our video infrastructure provider, Mux), and deliver Your Content to people you share it with — only to the extent necessary to operate the Service. This license ends when you delete Your Content or close your account (subject to short backup-retention windows, described in section 6).

2. What you promise about Your Content

By uploading Your Content, you confirm that:

  • You own it, or you have permission from whoever does, to host it on the Service and to share it with the people you choose to share it with.
  • It doesn’t infringe anyone’s copyright, trademark, privacy, publicity, or other rights.
  • It doesn’t violate any law where you live or where the Service operates.
  • It contains no CSAM, no incitement to violence, no malware, and no content that’s illegal under U.S. federal law.

We reserve the right to remove content or suspend accounts that violate these terms. We try to be reasonable about it and contact you first when we can.

3. Acceptable use

You agree not to use the Service to:

  • Distribute malware or attempt to break our systems
  • Resell hosting / share-link generation as a standalone product
  • Send unsolicited bulk email through any feature that triggers a notification
  • Scrape or mass-download content you don’t own
  • Circumvent payment, expiration, password, or access controls

4. Accounts and security

You’re responsible for keeping your sign-in credentials safe and for any activity under your account. Tell us immediately if you suspect your account has been compromised. We’ll work with you to lock it down.

We use Supabase for authentication and never see or store your password — sign-in happens via one-time email codes.

5. Subscriptions, billing, and refunds

Paid plans (Solo, Studio, Pro) are billed monthly via Stripe. You can upgrade, downgrade, or cancel at any time from the billing portal in your account settings.

Cancelling stops future billing but keeps your account active through the end of the current billing period. Refunds are not automatic — if you have a billing concern, email us within 14 days of the charge and we’ll resolve it case-by-case.

Trials: when you start a free trial, your card is collected up front and will be charged at the end of the trial unless you cancel before then. The trial length and pricing are shown on the signup screen.

6. Data, backups, and account closure

Your Content is stored on Cloudflare R2 and Mux. Project metadata (names, comments, approvals) is stored in Supabase Postgres. We back up Postgres daily and retain object versions on R2 for 30 days. These backups exist so we can recover from accidents, not as a long-term archive — you should keep your own master copies offline.

When you delete a project, asset, or account, we remove the primary copy immediately. Backup copies cycle out within 30 days. You can email nicholaskalisz@gmail.com to request immediate full deletion.

7. Service availability

We aim for high uptime but the Service is provided “as is.” We don’t guarantee any specific uptime percentage or that the Service will be available at all times, and we won’t be liable for any loss resulting from downtime or service interruptions.

We may modify, suspend, or discontinue any part of the Service at any time. If we permanently shut down the Service, we’ll give you reasonable advance notice and a way to export your data.

8. DMCA / copyright notices

If you believe content on the Service infringes your copyright, send a written DMCA notice to nicholaskalisz@gmail.com including:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing (with URL)
  • Your contact information
  • A statement that you have a good-faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

We’ll respond to valid notices by removing the content and notifying the user who uploaded it. They can file a counter-notice if they believe the takedown was a mistake.

9. Limitation of liability

To the maximum extent permitted by law, Mountain Creative Directory will not be liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the Service.

Our total cumulative liability for all claims related to the Service is capped at the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions don’t allow these limitations. Where that’s the case, the limits above apply to the maximum extent allowed.

10. Indemnification

You agree to defend and indemnify Mountain Creative Directory against any claims, damages, or expenses (including reasonable attorney’s fees) arising out of (a) Your Content, (b) your violation of these Terms, or (c) your violation of any third-party rights.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top and, for material changes, send you an email or show a notice on the Service. Continued use after a change means you accept the new Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws principles. Any disputes will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction.
